2025 Mercury Prize - Bowers & Wilkins Promotion Terms and Conditions

1. These terms and conditions (“Terms”) are the rules which apply to the 2025 Mercury Prize in Newcastle promoted by Mercury Prize Limited (“MPL”) on the official Mercury Prize Instagram account (the “Promotion”) to win a pair of Bowers & Wilkins Px8 S2 (the “Prize”).  

2. By entering the Promotion, entrants agree to be bound by these Terms. 

3. The details of the Promotion, the Prize and the date on which the Promotion closes will be indicated in the official Mercury Prize Instagram post announcing the Promotion, which, once published, will be part of these Terms.  Entries to the Promotion must be made in the manner specified in the Instagram post.  Failure to do so will disqualify the entry. After the closing date no further entries to the Promotion will be permitted. 

4. Entry is only open to residents of the United Kingdom aged 18 years or over.  

5. Each entrant may enter the Promotion more than once, but each entrant shall only be eligible to win a maximum of one Prize.  

6. There is no purchase requirement or fee to enter the Promotion.

7. There is no cash alternative to Prize. 

8. All entries will be collated and the Promotion winners shall be selected by a verifiable random computer process and contacted in accordance with the process outlined in the Instagram post. The decision in each case shall be final and no correspondence or discussion shall be entered into. The Promotion winners shall be given instructions as to how to collect their Prize.  

9. In the event that we are reasonably unable to contact a Promotion winner for whatever reason, that Promotion winner may be disqualified and an alternate winner may be selected.

10. Claims for the Prize must be made within the time and in the manner notified to the winner.  Failure to claim the Prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.

11. Each Prize is awarded at our sole discretion in accordance with these Terms and no Prize shall be awarded in the event of improper actions by or on behalf of any entrant (as determined in our sole discretion). 

12. Each Promotion winner may be requested to take part in promotional activity and we reserve the right to use the names and locations of that Prize winner, their photographs and audio and/or visual recordings of them in any publicity.

13. Mercury Prize Limited (“MPL”), its group companies, Bowers & Wilkins and Instagram do not accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, viruses, bugs or other causes outside their control.

14. MPL, its group companies, Bowers & Wilkins and Instagram do not accept any liability for any damage, loss, injury or disappointment suffered by any entrant entering the Promotion or as a result of accepting a Prize.  MPL, its group companies, Bowers & Wilkins and Instagram are not responsible for any problems or technical malfunction of any kind, including any injury or damage to an entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Promotion. Nothing shall exclude any party’s liability for death or personal injury as a result of negligence.

15. All entrants agree to adhere to Instagram’s Terms of Use and acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.  

16. The winner’s full name, contact number and email address will be collected and processed by MPL for the purposes of fulfilling the Prize. Any personal data relating to entrants will be used solely in accordance with the Data Protection Act 2018 and in line with the Mercury Prize privacy policy which can be found at: Privacy Policy. 

17. These Terms shall be governed by the laws of England and Wales and, in the event of any dispute, the courts of England and Wales shall have exclusive jurisdiction.
